    In his address to open the Bank of New York Mellon’s first Australian branch in Sydney on 29 September 2009, the Hon. Nick Sherry confirmed his intention to introduce legislation to repeal the FIF rules “very early” in the 2010 calendar year.
    With Christmas fast approaching it is useful to remember that the Fringe Benefits Tax (“FBT”) minor benefits exemption threshold is now $300 (previously $100). With this in mind, the value of minor and infrequent rewards and gifts that can be provided to your employees without you as the employer incurring any FBT liability is quite significant. Changes to the minor benefit exemption now provides opportunities for employers to spend much more on the provision of entertainment fringe benefits and gifts to their employees.
    The superannuation guarantee requires employers to provide sufficient superannuation support for their employees. You are obliged to contribute a minimum of 9% of an eligible employee’s OTE to a complying superannuation fund or retirement savings account (RSA). Your contributions need to be made at least every quarter.
     

    The purpose of the changes was to remove the general exemption that applied to foreign income and only apply it for certain aid or charitable or government employees.

    In his press release of the 12 May 2009, Treasurer Wayne Swan MP commented that the changes to be brought about by the draft legislation were to ensure that Australians working overseas ‘do not have an unfair advantage over workers who earn income and pay tax in Australia’.
