Mark is a Tax Consulting Principal of Moore Stephens Gold Coast and a former senior ATO officer and tax barrister with over 15 years tax dispute and litigation experience, who heads up their Tax Dispute Resolution Service.
The Service is an efficient and low cost approach to resolving clients’ tax or GST disputes in a way that provides the best chance of success, by adopting a range of appropriate dispute resolution strategies. Although no one likes a disagreement with the ATO, Mark can devise the most appropriate strategy for a client’s circumstances and provide a range of options to resolve any differences with the ATO.
Be it negotiating a favourable settlement at audit or claiming compensation for the ATO’s defective administration, our Tax Dispute Resolution Service can assist clients to achieve the best outcome.
Sometimes there is no option but to take on the ATO in the Administrative Appeals Tribunal (AAT). If that is the best option, our proven track record of running tax and GST cases in the AAT will maximise clients’ chances of success. With a wealth of litigation and negotiating experience and inside knowledge, Mark can represent clients in the AAT and in any dealings with the ATO to give clients the peace of mind and the knowledge that their affairs are being dealt with at the highest technical level.
For example, in GXCX v Commissioner of Taxation, Mark successfully had penalties in excess of $100,000 reduced to nil by the AAT and achieved a resultant reduction in GST liability for our client. In another unreported AAT case, Mark persuaded the ATO to reduce penalties by 80%, resulting in substantial dollar savings for our client.
